>>> Albert College appoints the Representative to represent Albert College visa potential students applying to study at Albert College and will assist the students to collect all necessary information and documentation leading to their enrolment at Albert College.
>>> The Representative must accept to act to the best of his abilities, on behalf of Albert College in good faith and according to the terms of this agreement.
>>> The agreement covers only a specifically named territory and does not apply to any other geographical region.
>>> The Representative will act at all times in his/her/its own capacity and the assignment does not constitute any form of employment or partnership arrangements between the two parties.
>>> The Representative will be subject to the laws and the policies of the above mentioned territory and by signing the agreement is confirming that he/she/it is legally allowed to act in such capacity. Albert College must be immediately informed in writing should the Representative lose the right to operate or become subject of any official investigation or accused of any irregularities.
Duties of Albert College :
>>> Albert College must regularly and promptly inform the Representative about all changes in regulations, policies and programmes within the College which might affect the operation of the Representative.
>>> Albert College must provide the basic marketing material required by the Representative, including the College prospectus, guidelines for advertising and promotional campaigns and information about courses and programmes on offer.
>>> All commissions and fees payable to the Representative must be paid by Albert College within 30 days of the student's registration in person at the College and the full payment of the annual tuition fee.
Duties and Responsibilities of the Representative :
The Representative must actively promote Albert College to bona fide students and ensure eligibility of the applicants recruited for Albert College, fulfilling the following duties:
>>> Give professional advice to the applicants on the selection of degree programmes and courses, using Albert College's prospectus and other approved information and promotional material.
>>> Verify that the applicant either meets or exceeds the entry requirements for Albert College by checking the original transcripts/degrees of the applicants before forwarding the application forms to the College. If copies of such documents are forwarded, they should be made from originals duly attested, signed and stamped by the Representative prior to the submission to Albert College.
>>> Place advertisements in media and undertake any other promotional activities such as participation in educational fairs and exhibitions at its own cost, but only with prior written approval of all such promotional material and activities by Albert College.
.>>> Collect the prescribed tuition fees from the students in the form of cheques or bankers drafts and issue receipt for the same, provided that all such financial instruments are issued in favour of Albert College Ltd, payable in the United Kingdom and delivered to the College prior to the registration of the respective student.
>>> The Representative is not authorised to issue visa supporting documents such as Offer Letters, Acceptance Letters or Visa Letters on behalf of Albert College.
>>> The Representative is not authorised to make any policy statements, undertake commitments (except for the recruitment of students) or make representations to the media, business or governmental organisations on behalf of Albert College.
Term and Termination :
>>> The representation agreement is for a period of one year, renewable at the sole discretion of Albert College on the basis of satisfactory performance of the Representative and mutual agreement.
>>> Albert College must send a notice to the Representative at least 3 months prior to the end of the term of the agreement indicating its decision for or against the renewal of the agreement.
>>> If the Representative decides not to renew the agreement, a minimum notice period of 3 months must be served on Albert College.
>>>Failure of the Representative in complying with any part of this agreement will be ground for cancellation of this agreement by Albert College, according to the following procedure:
- As soon as a breach of any article of this agreement is noticed, Albert College must give a written notice to the Representative, demanding corrective action within 30 days.
- If the Representative fails to comply for whatever reason, Albert College has the right to cancel the agreement without further notice.
- Any monies owed by either party at the time of the cancellation of the agreement or if the agreement is not renewed at the end of its term, must be settled in full within 30 days from the date of cancellation or the end of the agreement.
- In the case of a breach by the Representative resulting in cancellation of the agreement, Albert College reserves the right to demand remedy and compensation from the Representative for any damages or losses incurred.
Disputes :
Any disputes arising from this agreement shall be settled according to the laws of England, by arbitration or if that fails, in an English court.
